How safe is a virtual notarization?
There are many reasons why online notary is a safer alternative to a traditional in-person notary. We a technology that analyzes in mere seconds any state’s driver’s license, state-issued ID, or US Passport. This advanced identity verification process is all but impossible for a traditional in-person notary to perform and substantially reduces the likelihood of identity fraud. And all signed and sealed documents in a remote online notary session are sealed with tamper-evident technology, so any unauthorized changes to the document are easily detected. This is not possible with wet ink and paper notarizations, where it is very easy for someone to make wrongful alternations to a notarized document. The online notary session is recorded, and the recording is saved in the notary public’s record for a multi-year period. With such a recording, parties can review the session for any suspected signs of coercion or wrongdoing. The identity of a signer in an online notary session is verified using a two-step identity verification procedure consisting of third-party analysis of the signer’s identification document and a series of identity-proofing questions.
Does a signer “personally appear” in the presence of an online notary public?
Traditional in-person traditional notary requires that the document signer appear in the physical presence of the notary public. This requirement has become a difficult and impractical task with the current necessity of social distancing during the COVID-19 pandemic.
In contrast, remote online notarization does not require that the signer and the notary public be physically present with one another for the notarial act to be considered valid and legal. Instead, the signer can be considered to be legally “appearing” by audio-videoconference.
Because the signer can appear by videoconference, they can be located anywhere in the world during the notary session. And the notarial act will be legally valid under state law. Needless to say, this aspect of online notary makes the process dramatically faster, easier, and safer than an in-person traditional or mobile notary service.
How is a signer’s identity verified?
Unless the notary has personal knowledge of the signer, the online notary public verifies the signer’s identity by a technology-driven analysis of the signer’s photo identification and then having the signer answer several security questions.
The signer’s government-issued ID (such as a driver’s license, passport, or state-issued identification card) is validated in a process is called “credential analysis.” Credential analysis uses third-party technology to confirm the ID’s security features and that the ID is not fraudulent. The technology process also verifies that the ID is current and duly issued by accessing available information from the authority that issued the ID or from another authoritative source.
Next, the signer’s identity is confirmed using a process called “identity proofing.” Here the notary can affirm the signer’s identity by having the signer answer several dynamically-generated questions generated from public records and other authoritative databases. The signer must answer a sufficient percentage of these knowledge-based authentication questions within a prescribed amount of time that is set by state law. How is a document signed?
Each document to be signed in the online notary session is displayed on the screens of the notary public and the signer. The signer applies their electronically-created signature to the document, while the notary applies their digital seal, digital signature, and completes the notary certificate. The digital document contains the encrypted digital signing certificate of the notary public. This digital signing certificate is a modern-day version of the rubber notary stamp and makes the renders electronic document “tamper-evident” once it is applied. Therefore, any attempts to alter the tamper-evident document’s contents will be evident to any party accessing that document and its digital record.
Is remote online notary the same thing as eNotary?
Similar to an online notary session, eNotary involves the electronic signing and sealing of a digital document and is a digital alternative to wet ink and paper signings. And in an eNotary session, the signer and the notary public are in physical presence of one another. With remote online notary, however the signer appears in the presence of the notary remotely by means of two-way audio videoconference.
